Abstract

Objective: This study aims to examine and analyze the imbalance of legal relationships in standard form contracts within the gig economy. Method: This research employs a normative juridical method with statutory and conceptual approaches. The legal materials used include primary, secondary, and tertiary sources relevant to the issues of standard contracts and legal protection for workers in the gig economy. The analysis is conducted qualitatively to identify forms of imbalance and their implications for workers' legal protection. Results: The results indicate that the imbalance of legal relationships in standard form contracts within the gig economy arises from the dominance of platforms in determining contractual terms and conditions, including limitation of liability clauses, unilateral termination rights, and risk transfer to workers. This condition leads to weak legal protection for gig workers in terms of economic rights, job security, and access to justice. Furthermore, the absence of specific regulations governing the gig economy further strengthens the dominant position of platform providers. Novelty: Based on these findings, it is necessary to strengthen more comprehensive regulations and enhance government oversight of standard contract practices in the gig economy sector. These efforts are essential to create a more balanced legal relationship between platforms and workers and to ensure fair legal protection for all parties involved.
